REVILLA READIES COMMITTEE REPORT VS CYBERSEX

Senator Ramon “Bong” Revilla Jr. pressed for the passage of the Anti-Pornography Bill as he readies the committee report on the said measure that would arrest the prevalence of cybersex in the country. The senator stressed that is high time that the Anti-Pornography Bill be enacted to law so the government could fully penalize perpetrators of cyber prostitution. “We can not deny that sex trade in the country has evolved through the cyberspace, which is more accessible to anyone and anywhere in the world, including to the youth,” said Revilla, chairman of the Senate Committee on Public Information and Mass Media.

This was the statement of Revilla in the wake of the police raid in a suspected cybersex den in Bacoor, Cavite where 17 Filipinas were rescued including a minor.

He earlier called on law enforcement agencies and local governments to lock-up internet cafes in its jurisdiction that tolerate access to child pornography websites.

Revilla disclosed that his committee has already completed its committee report on his bill- Senate Bill (SB) No. 12- and on seven similar bills and one resolution to address the continuing proliferation of pornographic materials in various media, including the internet and other high tech forms of communication. He said the committee report is still to be signed by a number of members of the committee. Revilla appealed to the Lower House to pass a counterpart bill to expedite the enactment of this measure into law.

Mayor Strike Revilla, the senator’s younger brother, led police on Saturday in raiding a cybersex den in Bacoor, Cavite believed to be operated by a Japanese national, who eluded arrest. They were able to rescue 17 Pinays, including a minor hired by Japanese Sacho Kameda and Jasmin Javier. Kameda is still being hunted while Javier was brought in for questioning.

The two suspects will be charged of violation of Republic Act (RA) 7610, also known as Special Protection of Children against Child Abuse, Exploitation and Discrimination.

The lawmaker appealed to the Bureau of Immigration (BI) to issue a hold departure order against Kameda. “We must not let the primary suspect to just disappear without trial. It would be a big blow in our campaign against cyber prostitution. We will be a laughing stock to the international community if foreigners continue to operate illegal activities in the country,” Revilla explained.

SB12 aims directly to punish cyber-sex den operators and to slap stiffer penalties to those who publish, broadcast and exhibit pornographic materials through the use of traditional media, the internet, the “cyberspace”, cellular phones and other forms of media

Under the bill, any person who shall cause the publication, broadcast, exhibition or selling of pornographic materials shall be punished with 12 to 20 years imprisonment and a fine of not less than two hundred fifty thousand pesos. Any person who helps in the commission of the crime will face 12 year imprisonment and fine of not less than one hundred thousand pesos. “Here in the Philippines , the prevalence of pornographic materials via the internet and cellphones are not clearly punishable at present either by the Revised Penal Code or the Republic Act 9208, otherwise known as “Anti-Trafficking in Persons Act of 2003,” Revilla pointed out.

It puzzles many that the Philippines is obsessed with eliminating so called Cyber Sex dens but does little about prostitution at home.  Given that Cyber sex is a much safer environment for the girls to work, why is it seen as a much more heinous crime that actual prostitution?

Sex In Asia consulted some experts on the Philippines to try to get an insight into this apparent double standard.

Out on the ground sources gave us two possible explanations for this.  

The first is that Cyber sex tarnishes the image of the Philippines overseas and becomes a matter of National pride or embarrassment.

The second is that the local governing authorities including Police do not get any kick backs from operators of Cyber sex.   

“…the police and local government not only get kickbacks from the bars but often drink in these establishments and are given girls.  They get nothing from Cybersex so they love to raid them and look like they are really doing something…”

Michael John Malto, a teacher just got up to 20 yrs for having sex with 17-yr-old student in the Philippines

It is alleged that Michaels relationship with the girl lasted two years girl but the girl became “depressed and distressed” (or should it read Jealous) after learning of complaints of sexual harassment against the teacher. She then confided in her mother who filed an administrative complaint before school authorities. She also lodged a complaint in the Office of the City Prosecutor of Pasay City, which led to the filing of criminal charges against the teacher Michael John Malto.

According to the girl story:

“On Nov. 19, 1997, around 11 a.m., the complainant agreed to have lunch with petitioner outside the premises of the college. Since she was not feeling well at that time, he asked her to lie down in the backseat of his car.

She was surprised when he brought her to Queensland Lodge on Harrison Street in Pasay City. Once inside the motel room, he kissed her at the back and neck, touched her breasts and placed his hand inside her blouse. She resisted his advances but he was too strong for her. He stopped only when she got angry at him.

On Nov. 26, 1997, petitioner asked her to come with him so that they could talk in private. He again brought her to Queensland Lodge. As soon as they were inside the room, he took off his shirt, lay down in bed. She refused but he dragged her toward the bed, kissed her lips, neck and breasts and unsnapped her brassiere. She struggled to stop him but he overpowered her. He went on top of her, lowered her pants and touched her private part. He tried to penetrate her but she pushed him away forcefully and she sat up in bed.

But when the professor threatened to end their relationship, the girl hesitantly agreed to have sex with him.”

According to Michael’s story:

“The girl became his sweetheart when she was already 19 years old and after he was dismissed from Assumption College. On Dec. 27 and 28, 1998, they spent time together, shared their worries, problems and dreams and kissed each other. On Jan. 3, 1999, he brought her to Queensland Lodge where they had sexual intercourse for the first time. It was repeated for at least 20 times from January 1999 until they broke up in July 1999, some of which were done at either his or her house when no one was around.”

The court believed her story and he was found guilty back in 2001. He has been involved in a long appeal process since which he has finally lost this month. They have actually increased his minimum sentence and imposed additional financial compensation penalties against him so now he is truly fucked (not exactly legal language but I think that is the best appraisal of the outcome).

It seems Michael had a problem separating his work from his personal life. He was dismissed from the De La Salle University-Aguinaldo for having sexual relations with a student and sexually harassing three other students. His employment was also terminated by Assumption College for sexually harassing two of his students. We dare say this would have had a lot of bearing on his credibility and the outcome of the case.

I hinted above the complaint against Michael really seems to stem from Jealously and sour grapes in a relationship that had lasted two years (we will assume that the finding of the court and girls story are true).

Michael is a teacher of Philosophy (something he will now have lots of time to contemplate) but demonstrated poor judgment in pursuing his students in a country where there are so many available and hassle free girls around.

The schools he taught at are private schools and the students come from “good” upper middle class families that do not take kindly to teachers having relationships with their daughters.

There is also the matter of his professional relationship to his student. Even in countries like Australia where the actual age of consent is 16 the law would still prosecute someone in Michael’s position as anyone that is in a position of power and authority over minors are subject to special laws. The point here is that it not simply the age issue that the court was considering when prosecuting Michael but the abuse of his position of trust and power.

The real story may well be different from both accounts. It is implied but not actually stated that the girl was a virgin at the time Michael first had sex with her. We suspect she was not as it was not explicitly stated. The girl may have been sexually active at an early age and the initial encounter may have been not only consensual but actively sort by both. In such a situation how could any normal guy resist having sex with horny young school student?

The bottom line is that in most countries sex with a minor is considered rape regardless of how consensual it actually is. This is also the situation in the Philippines and in summary the high court said “A child exploited in prostitution or subjected to other sexual abuse cannot validly give consent to sexual intercourse with another person,”

Just a few days a go four Japanese nationals, including one woman, were arrested by Lapu-Lapu City police for videotaping two partners having sex on the seashore of an islet off Olango.  The tourists were charged with violation of Article 201 of the Revised Penal Code which punishes ‘indecent” acts and “obscenity”. They were released Thursday after posting P24,000 bail.

“This is fair warning to those who would like to enjoy our city. Enjoy yourself but do not abuse our hospitality, said Lapu-Lapu Police Chief Louie Oppus.

“We are trying to protect our integrity and our wholesomeness as a tourist destination.”

The police caught 26-year-old Miyawaki Yuki, the only female in the group, having sexual intercourse with her companion Yokomizo Masahi, 36, on Sulpa Islet at about 5 p.m. of Wednesday. Both are single. Their other companions Izuno Hiwaki, 24, and Takimoto Yuichiro, 40, were videotaping the couple. The visitors, all from Tokyo, Japan, are staying at a hotel in Cebu City.

Masahi, in a television interview, said they were all friends. He said the videotaping session was just a “hobby” with his girlfriend.

Sulpa islet, which is located off the southern tip of Olango Island, near Mactan, is known for its white sand beaches. It is about 10 to 15 minutes travel by boat from Olango mainland. The area has few residents staying in the area during daytime but no one is living there at night, said police.

Interviewed at the detention cell, the Japanese nationals said in halting English that they went to the remote islet for a “private” videotaping session and that the activity was for “leisure”.

However, the police chief thinks otherwise. Oppus said it was not the first time law enforcers received reports of tourists engaging in lewd activities in the islets of Lapu-Lapu.  Oppus said he believed the material was intended for sale as a pornographic video through the Internet or pirated VCDs or DVDs.

Oppus said police had arrested foreigners for similar offenses before, when he was not yet Lapu-Lapu police chief, but that charges did not prosper because the photos in the camera used were deleted. This time, he said, the evidence remained intact.

Police Inspector Junnel Caadlawon said lawmen made the arrest at about 5 p.m. and confiscated the video camera used in the filming as evidence.  Two bird wardens at the bird sanctuary in Olango Island earlier noticed the filming and reported the activity to the Lapu-Lapu City Police precinct in Sta. Rosa, Olango Island.  The police confiscated five digital cameras, two Panasonic Tape DVM 60 used for the pornographic movie, condoms and various belongings.

Our team of investigators rushed to the scene and filed this follow up report. Olango Island is about 40 minutes by ferry boat from Cebu and not really developed as a tourist destination with the exception of the bird sanctuary mentioned.  There are almost no cars on the Island.

The incident actually occurred in a protected area – a bird sanctuary for migrating birds.  There is an observation hut near the water which houses a very powerful telescope which the two bird wardens used to spot the activity.  More than likely the two warden were pissed off because they were not paid by the Japanese or jealous because they were not getting any.

Our investigators have not been able to determine if the Japanese were only filming for “leisure” as they claim but as there were only Japanese Nationals involved (thus no claim of local exploitation) the reaction seem excessive.

The Japanese made every effort to conduct their activities in private without offending the local population and were only discovered because of two wardens with a high powered telescope used for bird observation.

As for the comment by Police Chief Louie Oppus that this is this is fair warning to those who would like to enjoy our city…more like fair warning that you can not enjoy yourself in his city or even in hidden remote areas way out of the city.

The team spent the last two nights on Lapu Lapu and report that there is an abundance of bars allowed to operate that have nude dancing and its not uncommon for a bargirl to suck a customers cock openly for the cost of a few “Ladies Drinks”.  These same bars are often frequented by the local police that do not have to pay for drinks and take a girl out to the VIP rooms in the back for sex.

A local source commented that “In a more civilized country they would have simply received a fine but here they get put in jail while the locals get away with things ten times worse”.

Five Indonesian women and five Filipino women were reported to have been rescued from the Belaga district in central Sarawak on a 60,000 hectares property owned by a notorious vice kingpin.  It’s alleged that the women were “enslaved” and “forced” to provide sexual services to workers in and around the hydroelectric dam project site.  A Filipino woman believed to be the “mummy” was also arrested.

Police were alerted when one of the Filipino women sent several SOS messages via her cellular phone from Bakun to local media.

To my mind the claim of sexual slavery and forced sex is not supported by a couple of facts.  First if they were really sex slaves would they be stupid enough to let them retain their cell phones.   Secondly the police also reported that “We also recognized the Filipino woman whom we arrested in April and deported. She managed to return using a different identity,”.   So one of the so called sex slaves has already been rescued and deported in the past but must have just loved being a sex slave as she snuck back in.

The President the Philippines Gloria Macapagal Arroyo has created a five-member committee to investigate what one official has called the alarming rate of sexual harassment cases in the offices attached to Malacañang.

The chief presidential legal counsel Sergio Apostol was asked if he knew how many such cases had been filed, Apostol said: “I don’t have the exact number right now, but you may describe it as alarming. There are many cases [of sexual harassment] in the OP [Office of the President].”

According to a critic of the President who viewed the report in full it is “very long and contains a lot of fat language about how it was such a big problem and was long over due but gives no real details.  This is not surprising coming from the five year presidency of Gloria Macapagal Arroyo who is known for her rhetoric with out substance.  This is the typical storm in a tea cup political distraction technique she employs to divert attention from far more serious failings of her presidency”.
